Scott Lowe will be presenting a 2-day NHI Course in Berlin, VT, titled “Principles and Applications of Highway Construction Specifications,” on March 14 and March 15, 2019. The course includes content that highlights the role of specifications as contract documents and tools for assigning risk. Course participants will engage in lessons and practice sessions to identify types of specifications, select the most appropriate type for a given project, and generate an original, effective highway construction specification. Emphasis is placed on the use of basic grammar and writing style so that participants can produce correct, consistent, clear, complete, and concise specifications.

On March 5, 2019, Bill Haydt will present a Lorman Seminar, “Calculating the Cost of a Change.” Bill will discuss the misconceptions and uncertainty surrounding the pricing of construction changes. Contractors will learn what they must include to be made whole. Owners will learn what they should pay, and what they shouldn’t pay. CMs, attorneys, and the consultants and accountants that advise them will learn what is needed to accurately and persuasively price a change. Bill’s focus will be on the hard topics – the legitimate damages associated with delay, the real costs of inefficiency, and the balancing concerns when pricing acceleration. He will also review the sometimes controversial areas of unabsorbed home office overhead, interest, and consequential damages.

On February 28, 2019, Geoff Page will present a Lorman Webinar “Reading and Understanding Highway Plans.”
In this 90-minute webinar, Geoff will discuss how to gain a better understanding of how to read and comprehend DOT project plans. Reading and understanding DOT construction plans is clearly critical for anyone involved with transportation projects. Contractor estimators need to know how to read these plans to properly bid the projects. Once the project is awarded, contractor personnel and subcontractors performing the work need to be able to follow the plans to accurately build the work. Engineers, inspectors, and consultants working for the DOTs also need to understand the plans, and while this seems to be an obvious requirement for managing the work, competencies vary. Other people involved with the work such as environmental specialists, geotechnical technicians, material providers, and outside agencies affected by the work also need an understanding of the plans. Oftentimes people with various project responsibilities know how to look at their particular piece of work on a set of plans but not much else. There may be parts of a plan set that relate to someone’s work that are not called out in the parts of the plan that specifically describe certain work. Mark Nagata and Ryan Ebner will be presenting two 2-1/2 day NHI Courses in Columbia, SC, “Managing Highway Contract Claims: Analysis and Avoidance,” from February 12-14, 2019 and from February 19-21, 2019. The course provides the basic tools to address the management and avoidance of highway construction claims. Mark and Ryan will present the evaluation of a highway contract claim by focusing on three claim components: entitlement, impact, and cost. Participants will learn claims avoidance techniques, as well as how to identify and review best practices associated with successful dispute resolution.

Owners Perspective, the official magazine of Construction Owners Association of America (COAA), recently published Mark Nagata’s article entitled “Watch Out for this New Liquidated Damages Loophole.” The article addresses the American Society of Civil Engineer’s (ASCE) new standard that could result in contractors sidestepping payment of liquidated damages. Mark discussed the importance for owners to understand what the offsetting delay argument is and how to protect themselves.
