Mark Nagata and Ryan Ebner will be presenting two 2-1/2 day NHI Courses in Columbia, SC, “Managing Highway Contract Claims: Analysis and Avoidance,” from February 12-14, 2019 and from February 19-21, 2019. The course provides the basic tools to address the management and avoidance of highway construction claims. Mark and Ryan will present the evaluation of a highway contract claim by focusing on three claim components: entitlement, impact, and cost. Participants will learn claims avoidance techniques, as well as how to identify and review best practices associated with successful dispute resolution.

On January 15, 2019, Bill Haydt will present an ASCE Webinar titled “Evaluation and Quantifying Inefficiency in Construction: A Case Study Approach.” Bill will focus on the topic of inefficiency management during construction projects. Several case studies will be discussed, dealing with issues associated with quantifying inefficiencies in construction. The course includes content that highlights the role of specifications as contract documents and tools for assigning risk. Course participants will engage in lessons and practice sessions to identify types of specifications, select the most appropriate type for a given project, and generate an original, effective highway construction specification. Emphasis is placed on the use of basic grammar and writing style so that participants can product correct, consistent, clear, complete, and concise specifications.

Owners Perspective, the official magazine of Construction Owners Association of America (COAA), recently published Mark Nagata’s article entitled “Watch Out for this New Liquidated Damages Loophole.” The article addresses the American Society of Civil Engineer’s (ASCE) new standard that could result in contractors sidestepping payment of liquidated damages. Mark discussed the importance for owners to understand what the offsetting delay argument is and how to protect themselves.

Bill Haydt will be a speaker on a panel presentation at the Defense Research Institute’s first annual Construction Law Boot Camp, Construction Law 101, in Chicago, IL, on November 8, 2018. The panel includes Bill Haydt, Philadelphia, PA, Rinaldo J. Cartaya, Orlando, FL, and Lisa Torron-Bautista, Boca Raton, FL. This 1-day in-depth workshop will focus on key aspects of the construction claims and litigation process.
Their 1-hr. presentation, entitled “The End-Game: How to Develop and Implement Your Resolution Strategy,” will focus on how moving a complex claim from its initial stages to resolution requires a solid strategy. A significant part of that strategy involves evaluating the technical aspects of the claim and identifying how the technical expertise of an expert witness can be used to prosecute and defend the claim. They will also discuss how counsel and expert witnesses can work together throughout the process to resolve claims, narrow the issues, and, if necessary, prepare for trial.
