Scott Lowe and Bill Haydt will be presenting a 2-1/2 day NHI Course in Shoreview, MN, “Managing Highway Contract Claims: Analysis and Avoidance,” from February 13-15, 2018. The course provides the basic tools to address the management and avoidance of highway construction claims. Scott and Bill will present the evaluation of a highway contract claim by focusing on three claim components: entitlement, impact, and cost. Participants will learn claims avoidance techniques, as well as how to identify and review best practices associated with successful dispute resolution.

On March 14, 2018, Scott Lowe will present “Calculating the Cost of a Change.” Scott will discuss the misconceptions and uncertainty surrounding the pricing of construction changes. Contractors will learn what they must include to be made whole. Owners will learn what they should pay, and what they shouldn’t pay. CMs, attorneys, and the consultants and accountants that advise them will learn what is needed to accurately and persuasively price a change. Scott’s focus will be on the hard topics – the legitimate damages associated with delay, the real costs of inefficiency, and the balancing concerns when pricing acceleration. He will also review the sometimes controversial areas of unabsorbed home office overhead, interest, and consequential damages. On October 18, 2017, ENR published Mark Nagata’s viewpoint piece entitled, “The Flaw in ASCE’s New Project Delay Guidelines.” The piece addresses American Society of Civil Engineer’s new Schedule Delay Analysis Standard’s inclusion of a recommended guideline that attempts to increase an owner’s obligation to grant time extensions for “non-critical path” delays.

Bill Haydt will be presenting “Can a Contractor be Entitled to a Time Extension if the Delay is not Critical?” at the OTE Conference on 10/10/17, in Columbus, Ohio. This 2-day event is attended by more than 3,000 transportation professionals throughout the nation. OTEC is co-sponsored by the Ohio Department of Transportation and Ohio State University. Bill’s 1-1/2 hr. presentation will focus on three basic areas: what an offsetting delay is and how it would upset the status quo; the current state of practice as it relates to the determination of the contractor’s entitlement to a time extension; and how a contract can be modified to address the change in the status quo.
