On May 5, 2020, Scott Lowe and Mark Nagata will present a Webinar for the Upper Great Plains Transportation Institute “Determining a Contractor’s Entitlement to a Time Extension Due to COVID-19.”  Scott and Mark will review the Wyoming, Montana, and North and South Dakota DOT contracts. They will discuss what these contracts require regarding a contractor’s obligations to establish entitlement to a time extension for alleged COVID-19 delays. They will look at whether COVID-19 delays are excusable under a contract, and discuss why they may not be compensable. They will discuss how to analyze a project’s schedules to quantify a delay associated with COVID-19, as well as identify the required documents a contractor must submit to verify and quantify COVID-19 delays.
